Presentation Topic: Tales from the Construction Claims Crypt & Lessons Learned 

Abstract - Construction industry surveys indicate that one of the most common causes of claims and disputes is inadequate contract administration. This paper presents 10 “war stories” to illustrate some pitfalls owners and contractors all too often fall into. The paper is based on multiple real-life projects and discusses the claims that arose – the how and the why. The paper describes the outcome of each claim and offers “lessons learned” from each claim situation some for owners, others for contractors, and some for both.

James G. Zack, Jr. is the principal of James Zack Consulting. Jim was formerly the Executive Director, Navigant Construction Forum™ and previously, Executive Director, Corporate Claims Management Group, Fluor Corporation. Previously, he was Vice President of PinnacleOne and Executive Director of the PinnacleOne Institute. Earlier in his career Jim was a Senior Construction Claims Consultant, CH2M HILL. For more than 54 years, he worked on both private and public projects in 36 States in the U.S. and 39 countries abroad. Jim is a Fellow of AACE International, the Royal Institution of Chartered Surveyors, the Guild of Project Controls, and the Society of Construction Claims Specialists. He is a recognized expert in mitigation, analysis and resolution or defense of construction claims. Jim has authored or co-authored more than 125 papers and other publications and presented to more than 250 organizations around the globe. He is Certified Construction Manager, Certified Forensic Claims Consultant, Expert Certified Construction Claims Specialist, Expert Certified Construction Delay Analyst, and Project Management Professional.
