Under the Mental Capacity Act (NI) 2016, any deprivation of liberty for individuals aged 16 or over who lack capacity must follow a strictly prescribed legal procedure to be considered lawful. These safeguards are increasingly relevant beyond health and social care, making it essential for professionals to understand specific protocols to ensure rights-based protection for themselves and those they support.

This course is designed for health, social care, and legal professionals working with children and young people with complex disabilities or mental health needs. Delivered by Eamonn McNally (CLC), a Legal Advisor, (Directorate of Legal Services), Katie Mercer (CLC) and Dr Ciara Fitzpatrick, (QUB) 

Key outcomes include identifying lawful deprivations, assessing capacity, including fluctuating capacity, and conducting thorough "best interests" assessments.
