Is the Constitution of Ireland (still) an obstacle to Irish reunification?

The Honourable Mr Justice Gerard Hogan, MRIA will explore how the Constitution—originally intended to end partition—has instead reinforced the institutions of the Southern State. Far from being a barrier for the reasons once claimed, its adaptability and success have deeply shaped the lived experience of the population, with profound implications for any future debate on reunification.

In the 1970s and early 1980s, critics frequently argued that certain provisions of the Irish Constitution posed an obstacle to reunification and that constitutional reform could pave the way for a new beginning. Since then, significant changes have been made: the deletion of the Catholic Church’s special position (1972), the removal of the ban on divorce (1996), and the revision of Articles 2 and 3 under the Good Friday Agreement (1998–1999). Yet, these reforms have not necessarily brought unity closer.

The Honourable Mr Justice Gerard Hogan, MRIA has served as a judge of the Supreme Court since October 2021. He previously sat on the High Court and Court of Appeal and was Advocate General at the Court of Justice of the EU. A member of the Constitution Review Group (1995–1996), he is co-editor of Kelly: The Irish Constitution and author of The Origins of the Irish Constitution 1928–1941 (RIA, 2012).
