Description
This is a recording of “Ethics and the Mediation Process” with Anne Lawlor Goyette, from Signature Resolution.
This presentation will explore key ethical issues that arise during settlement negotiations in civil mediation, with a specific focus on California’s rules and laws. The presentation will also address the ethical obligations that underpin effective mediation, including competence, diligence, clear communication and a commitment to honor and fair dealing. When counsel approach mediation prepared, act in good faith and prioritize ethical standards, their settlement efforts are more likely to be successful, leading to agreements that are sustainable and beneficial for all parties.
Mediation offers a range of benefits over traditional litigation, including confidentiality, cost savings, reduced stress and quicker resolutions. It empowers clients, attorneys and insurance professionals to control the process and shape outcomes rather than relying on the opinions and biases of judges and juries.
With over 25 years of experience in Alternative Dispute Resolution, Anne Lawlor Goyette recently joined Signature Resolution as part of the inaugural ADR team in their new Silicon Valley office. Since 1998, Goyette has successfully managed and resolved thousands of complex disputes as a full-time mediator, special master and arbitrator.
