Speakers details:,

Richard Booth KC,1 Crown Office Row

Richard Booth KC has practised at 1 Crown Office Row since being called to the Bar by Middle Temple in 1993 and is current Head of Chambers.

He specialises in clinical negligence, disciplinary / regulatory law, personal injury (especially brain and sports injuries), costs, inquests and sports law.

Richard is recognised as a ‘Leading Silk’ in Clinical Negligence and Professional Discipline by Chambers & Partners and was nominated for their 2018 ‘Professional Discipline Silk of the Year’ Award.

Richard is instructed predominantly on behalf of claimants in this field, but has also had a niche practice defending a well-known chain of fitness clubs. He is particularly expert in claims involving brain injury, from the maximally damaged to the subtle presentations.

In the sporting context, Richard has been involved in many serious injury claims over the years involving incidents on the field of play, where the defendants have been both opponents and referees.

John de Bono KC , Serjeants’ Inn

John was the Legal 500’s Clinical Negligence Silk of the Year for 2023. He is highly sought after by both claimants and defendants and is comfortable with cases of the greatest complexity and value. He is particularly known for his approach to causation and represented the successful claimant in CNZ v Bath. Solicitors value his ability to cut to the heart of the matter and clients appreciate his empathy and kindness.

John is primarily a clinical negligence specialist and is in demand for both claimants and defendants.

John has a special interest in cerebral palsy as well as being instructed in many other cases involving acquired brain injury in children and adults, spinal cord injury, brachial plexus injury, amputations and Fatal Accident Act cases, particularly those involving large dependency claims.

There is a large crossover between clinical negligence and other personal injury claims and John is regularly instructed in seven figure PI claims including those arising out of road traffic accidents and accidents at work.

Michael Rawlinson KC , 12 King’s Bench Walk

Michael’s principal areas of practice are claims in which exposure to noxious substances are alleged to have led to long-term adverse health effects. He is instructed by victims, exposers and their insurers.

Since such claims often involve the development of cancer many years after exposure, much of his instruction requires the marshaling and presentation of very large quantities of historical documents evidencing or negativing either the fact of exposure or the guilty knowledge relating to it.

He works extensively with lawyers from other common law jurisdictions. Under this general description fall specific areas of litigation: occupational exposure to asbestos/other carcinogens and exposure to manufactured products made available to the public.

In addition he accepts a significant number of instructions each year on behalf of service personnel (or their survivors) where injury arises from service life. He is often instructed to appear at the initial fact-finding Inquest and thereafter within subsequent civil litigation. He is regularly instructed in respect of air crashes (fixed and rotary wing) and other aspects of aviation health and safety. More generally, Michael is instructed by insurers where a wider strategic interest arises out of specific litigation. He considers to be a core part of his work to regularly give talks seeking to signpost where the law of causation appears to be heading. He accepts instructions from ‘both sides’ in catastrophic head and spinal injury.

Notwithstanding the advent of 0% CFA/QOCS claims he is not risk averse where legally interesting or otherwise significant issues arise. Recent work has required him to provide advocacy arising from such diverse topics as the nature of the UK’s level of control over Sovereign Base Areas in Cyprus, the system of International aviation regulation operating within the UK, the alleged effect of environmental exposure to organophosphates and the historical behaviour of manufacturers of asbestos products within the UK market.

Hugh Preston KC, 7BR

Hugh Preston KC (ranked as a “Star Individual” by Chambers & Partners 2023) is a leading silk in the fields of Clinical Negligence, Personal Injury, Consumer Law and Product Liability. He has particular expertise in all aspects of group litigation. He has longstanding wide experience of all aspects of personal injury litigation including historic sexual and physical abuse (particularly group actions involving child abuse and claims against religious and state institutions), claims arising from overseas accidents in the private security industry involved in combat operations in Iraq and Afghanistan, and the full range of maximum severity claims. More recently he has been consulted in respect of claims arising from the administration of Covid 19 vaccines to vulnerable persons/children.

Robert Parkin, Deka Chambers

Robert Parkin is an established mixed civil practitioner. Personal injury claims form an important part of Robert’s day-to-day practice. He acts, routinely, for both Claimants and insurer Defendants; in a very large range of accidents from simply road traffic collisions to industrial accidents; claims involving assaults; and claims arising from lack of supervision, for example, in a school environment. This ranges from simple, low value work, to complex, high value, claims involving brain damage. A large portion of Robert’s work involves bringing and defending claims under the Highways Act 1980 relating to slips and trips on the public highway. He has acted in the defence of such claims for a range of high profile clients, including a nationally recognised landholding charity; an airport; and local authorities. Robert has held an unusually large number of roles in the legal sector, having previously been a paralegal advocate, solicitor, a solicitor-advocate, and a OISC Level 3 accredited immigration consultant. He brings this range of expertise to the bar and uses it to find innovative solutions to common problems- having often faced similar problems himself at one time in practice.

Kate Lumbers, 7BR

Kate Lumbers specialises in clinical negligence and personal injury work. She has been recommended as a leading junior in the Legal 500 and Chambers and Partners for a number of years. Kate acts for claimants in clinical negligence, brain injury and personal injury in high-value and complex work. She has extensive experience representing families and other interested parties at inquests. Kate is highly experienced across all areas of personal injury work. She focuses on catastrophic injury claims arising from head and spinal trauma, multiple injury cases and high-value Fatal Accident Act claims. As such she is used to dealing with complex medical evidence, difficult causation issues and Claimants lacking capacity.

Colm Nugent, Gatehouse Law

Colm is a specialist barrister in the fields of personal injury and related insurance issues. He is also instructed in a variety of disputes outside these core fields including difficult interlocutory applications, having lectured extensively on the CPR and related costs issues.

Colm acts for both Claimants and Defendants in all aspects of injury and related disputes with a particular focus on lower limb injuries, subtle brain injury (especially those leading to an increased risk of dementia), complex loss of earnings claims, hand injuries and long-term loss claims as well as fatalities. He is an acknowledged specialist in claims concerning the application of the Defective Premises Act, which has taken him to the Court of Appeal this year.

Colm lectures regularly on the CPR, litigation tactics, defending fraud claims, bringing complex loss claims and issues arising from disability and interpretation of the Ogden reduction factors. He regularly speaks at training events and seminars,
