Easements and restrictive covenants may appear routine at first sight, but they can quickly give rise to difficult, expensive and contentious problems.

Rights of way, rights to park, rights to store goods, informal access arrangements, missing documentation, ambiguous plans, obsolete covenants and uncertain beneficiaries can all cause problems for buyers, sellers, lenders, developers, landlords and tenants. Advisers need to know not only the underlying law, but also how to identify the risks, report them clearly, and suggest practical solutions.

This live online course is suitable for commercial property lawyers and conveyancers. It will provide a practical review of easements and restrictive covenants, with particular emphasis on the issues that arise in everyday transactional work.

The course will explore:

• Scoping the retainer and reporting on easements and restrictive covenants.
• Which legal rights are capable in law of being easements - including the right to park and the right to store.
• Protecting legal and equitable easements - remembering the basics.
• Rights of Way tips and traps.
• Investigating the enforceability of restrictive covenants.
• An overview of the application of Section 84 LPA 1925 applications.
• Using defective title insurance to plug gaps in title arising from problems with restrictive covenants.
• Lessons from recent case law.

Delegates will receive extensive written notes to support their learning, and there will be ample opportunity for questions and discussion throughout the session.

Presented by Ian Quayle. Ian qualified as a solicitor and worked in private practice for 13 years specialising in property law matters including residential development work, commercial acquisitions and disposals. Ian has delivered over 1500 property related training courses for city and regional firms, local law societies and local authorities. His training style and delivery is relaxed, but he is able to explain the law and practical issues relating to the training topic in a way that ensures delegates learn, or reinforce learning, and derive meaningful benefit from the training provided.

The price for this is £199 + VAT. This is a per organisation price, so up to 10 of your colleagues can participate at absolutely no extra charge, even if they are viewing it from a different location or at a different time. So, of course, if there are 10 of you the cost per delegate would be just £19.50 per head.

For firms with four or fewer partners, you can purchase a single place at the conference for £99 + VAT
