TA6 and Upfront Information: Managing Risk in Residential Conveyancing
Residential conveyancing is increasingly front-loaded. More information is expected earlier, estate agents and sellers are under pressure to provide material information at the outset, and conveyancers are having to decide what they can safely rely on, what needs to be checked, and what should trigger further enquiries.
The TA6 form sits at the heart of that process, but it also creates risk. What should a conveyancer do where replies are incomplete, inconsistent or simply wrong? How far are you expected to verify what the seller has said? What happens if circumstances change before exchange? And where does responsibility lie between seller, estate agent and conveyancer?
This practical two-hour course with Lorraine Richardson will examine how the current TA6 form and the developing emphasis on upfront and material information should be handled in day-to-day practice. It will focus particularly on managing the risks of misrepresentation, negligence claims and misplaced reliance, while keeping transactions moving efficiently.
The session will also cover leasehold and managed-property information where relevant, together with practical file-management and risk-control steps that conveyancers can use immediately.
- the current TA6 form and how it should be used in practice;
- what “upfront information” means and how early in the transaction information should be gathered;
- material information and the interaction with estate agents and sellers;
- what conveyancers should and should not be expected to verify;
- incomplete, inconsistent or inaccurate replies;
- changes in circumstances between instruction and exchange;
- enquiries, reliance and caveat emptor;
- misrepresentation and professional-negligence risks;
- leasehold/managed-property information where relevant;
- practical file-management and risk-control steps.
Learning outcomes
By the end of this course, participants should be better able to:
- use the current TA6 form effectively and identify areas that may require further investigation;
- understand what is meant by upfront information and material information, and when that information should be obtained;
- distinguish between information that a conveyancer can reasonably rely on and information that may need to be checked or clarified;
- deal appropriately with incomplete, inconsistent or inaccurate replies and changes arising before exchange;
- understand the relationship between enquiries, reliance, caveat emptor and misrepresentation;
- recognise the main areas of professional-negligence risk arising from property information;
- handle relevant leasehold and managed-property information more effectively; and
- adopt practical file-management and risk-control procedures to reduce exposure while keeping transactions moving.
