This half-day online conference will be delivered by 7 clinical negligence QCs and will focus on a carefully selected range of important topical issues and problem areas in clinical negligence, from the latest developments with regard to the rise of fundamental dishonesty to how certain now is the law on vicarious liability in relation to clinical negligence,  through to the effective use of expert witnesses, from selection to cross examination and financial resources and the standard of care.

The conference will be raising money for The Lee Spark Necrotising Fasciitis Foundation (see more below).

Patricia Hitchcock QC, Cloisters (Chair) 

Patricia has been recommended as a leading practitioner in both clinical negligence and personal injury by Chambers & Partners UK and Legal 500 for many years. She was called to the UK Bar in 1988 and her initial common law practice was dominated by criminal defence (over 100 Crown Court trials), plus personal injury, employment, discrimination and education law. Specialised in medical cases in 1996. Busy High Court and appellate practice; regularly instructed in major multi-million pound cases on both liability and quantum, especially brain and spinal injury; cancer; psychiatric negligence; fatal accidents. Accredited mediator since 2003. Took silk 2011. Appointed Recorder (in Crime) 2018.

Richard Booth QC, 1 Crown Office Row

Richard is instructed in cases of the highest value and complexity, his clinical negligence practice is split approximately 50/50 between claimants and defendants. He has a particular expertise in high value clinical negligence claims arising out of a sporting context, involving doctors and physiotherapists. He is recognised as a ‘Leading Silk’ in Clinical Negligence and Professional Discipline by Chambers & Partners and is the current head of chambers at 1 Crown Office Row

Ben Collins QC, Old Square Chambers

Ben is regularly instructed by both claimants and defendants in complex and high-value clinical negligence and personal injury claims. He has enormous experience in addressing medical issues and an in-depth understanding of the work of clinical professionals. Joel Donovan QC is a prominent and highly-regarded clinical negligence and personal injury specialist. In the clinical negligence field he is particularly known for his expertise in cauda equina cases, claims involving delayed recognition and treatment of spinal cord compression, birth injuries, and secondary brain injury. His personal injury work centres on traumatic brain and spinal cord injury, and claims arising from workplace stress.

Dr Simon Fox QC, Serjeants' Inn Chambers

Simon is very much a clinical negligence specialist. He has a nationwide reputation for using his medical background and expertise to fight difficult and complex cases on breach and causation. Simon is a medically qualified specialist clinical negligence silk with 25 years’ experience. Simon trained, qualified and worked firstly as a doctor in the UK, New Zealand and Central Africa. His experience covered most areas of medicine and surgery and included accident and emergency medicine, neurosurgery and treating casualties from the Mozambique civil war. As a barrister he has specialised in clinical negligence and, in particular, in cases with difficult or complicated issues on breach and causation. He is one of the few barristers to have succeeded on a disputed material contribution causation argument at trial.


Caroline Harrison QC, 2 Temple Gardens

Caroline specialises in clinical negligence and medical law (especially concerning research & genetics; and including data protection and issues regarding medical records); complex personal injury litigation; related professional indemnity insurance; and health and safety claims. Her principal work involves neo-natal and adult brain damage; spinal injury; death; psychiatric injury; chronic pain and a broad range of diagnostic and treatment errors in primary and tertiary care. Her professional indemnity work usually relates to under-settlement or mismanagement of medical claims. The majority of Caroline’s work involves very complex medical or legal issues

Robin Oppenheim QC, Doughty Street Chambers

Robin is known for cutting edge work in clinical negligence and product liability and is listed as a leading silk in the major directories in both fields​. ​The focus of Robin’s practice in the field of clinical negligence developed over 30 years of practice is high value catastrophic brain and spinal injury for children and adults with a particular focus on complex antenatal, obstetric, neonatal, paediatric and spinal claims. He has also developed an expertise in meningitis and meningococcal disease litigation. He regularly acts in wrongful birth cases and undertakes catastrophic injury PI claims. Robin has been involved in a significant number of highly complex liability claims and quantum claims of maximum severity in the field of clinical negligence claims over the last year, with many millions pounds of damages secured for claimants. His current case mix includes numerous cerebral palsy cases, adult and child meningitis/sepsis cases, spinal injury and wrongful birth claims, and foreign jurisdiction damages claims.

The Lee Spark NF Foundation

Necrotising fasciitis (NF) is commonly known, rather inaccurately, as flesh-eating bug and is an extremely  serious and rare infection that results in the death of parts of the body's soft tissue. It typically has a sudden onset which spreads very rapidly with a mortality rate ranging from 20% to as high as 80%.

The mission of The Lee Spark Necrotising Fasciitis (NF) Foundation is:

- to help those whose lives have been affected by necrotising fasciitis and other severe streptococcal infections 

- to educate medical staff who are involved with investigating, diagnosing and treating NF.

- promote recognition of the early signs and symptoms of necrotising fasciitis and severe streptococcal infection

It was established in January 2000 by the mother of Lee Spark who lost her son to this terrible disease.

Why this charity?

In 2009, David Jacobs, of The Legal Training Consultancy contracted Necrotising Fasciitis, which led to multi-organ failure, toxic shock, sepsis and Steven Johnson Syndrome/Toxic Epidermal Necrolysis. He was in intensive care in an induced coma for 14 days and at one stage was given a 5% chance of survival. To save his life his left arm was amputated to the shoulder. Without clinical negligence on the part of the hospital it was most likely that he would have suffered little lasting damage. The matter was settled out of court.
