David Hart QC, 1 Crown Office Row
David Hart QC practises in environmental law, medical law, professional negligence and construction. He has also appeared at a number of major public inquiries. David has particular experience of group actions, in the environmental field (eight group actions alleging odour nuisance, four alleging dust & noise and a petrol contamination claim) and in medical cases.
David’s environmental work covers the whole range of issues – litigious, regulatory, planning, public law, criminal and transactional work – over all subject areas including water (Cambridge Water), waste (SRM, REPIC), air (Coalite), odour (Dobson), noise (Dennis, Watson), fishing (cockles, polluted trout streams, and Mott about salmon licences), windfarms (Macarthur and public inquiry). He also has a wide contaminated land practice, including two leading appeals (Sevenoaks and Sandridge).
Samantha Riggs, 25 Bedford Row
Samantha Riggs is an established and well regarded leading junior advising and defending corporate and individual defendants in complex fraud and regulatory investigations and prosecutions with extensive experience in environmental crime with particular expertise in waste management/environmental permitting and statutory nuisance. She often advises pre-interview/pre-charge, is accustomed to taking a pro-active approach at the outset of proceedings and is skilled in taking pre-trial challenges including legality of search warrants, abuse of process arguments and interpretation of the Environmental Permitting Regulations. Samantha is methodical in the preparation of cases with an eye for detail and skilled in disclosure. Her other regulatory work includes health and safely, food safety, trading standards. She is also experienced in judicial review.
Christopher Badger, 6 Pump Court
Chris Badger has an established practice in commercial regulatory investigations and prosecutions, specialising in environmental enforcement, acting for both corporate and individual defendants and on behalf of the Environment Agency. High profile cases in which he has recently been instructed include Environment Agency v CRL, the Environment Agency’s largest ever hazardous waste investigation, Environment Agency v Walker & Son (Hauliers) Ltd, the defining case on liability of landowners in environmental disputes; R v Rogers, Beaman and Tapecrown Ltd, the leading authority on the use of fresh evidence in appeals against sentence to the Court of Appeal and Environment Agency v WB Ltd, the most significant environmental prosecution of its kind for the illegal export of waste abroad. He is often asked to provide early stage advice into on-going investigations, both pre-interview and pre-charge. Recent written advice and lectures have included issues on water pollution, legal personality and “linked organisations”, the definition of causation, the meaning and treatment of hazardous waste, environmental liabilities for private investors and institutional and regulatory steps required to achieve ‘equivalence’ with current environmental standards in a post-Brexit environment.
Dr Anna Willetts, Gunnercooke LLP
Anna is dual-qualified, having completed a PhD in geochemistry and working as an environmental consultant for 5 years, before qualifying as a lawyer. Anna is an environmental criminal defence lawyer, representing waste and recycling businesses and directors. She advises and defends companies who are prosecuted by the regulators (Environment Agency and local authorities) for environmental offences. She is co-authoring a book with a barrister and technical specialist on the practical application of waste management law.
Asitha Ranatunga, Cornerstone Chambers
Asitha specialises in Planning & Environment and Licensing law. Within those fields his practice incorporates related Administrative & Public Law work. He regularly appears at public inquiries, hearings, and before the Higher Courts. His clients include developers and individuals as well as local authorities and residents' groups. He provides strategic and legal advice across a range of sectors including development (residential, retail, and leisure), infrastructure (renewable energy and highways), and regulatory control (environmental enforcement). Asitha brings approachability and pragmatism to all of his work and draws on over 15 years' experience at the Bar. He is consistently ranked as a leading junior in the main guides to the profession.
Simone Aplin, Anthesis
Simone is a Chartered Waste Manager with over 20 years’ experience in waste and resource management in operations, as a regulator and now as a consultant. As a Technical Director in Anthesis, she works with public and private sector clients across a wide range of resources & waste issues. This includes support to develop and consult on a Resource & Waste Sector Deal for the UK Resources Council and leading the development of a nationwide smart waste tracking system for Defra. Simone acts as an expert witness to UK courts in criminal and civil disputes, preparing expert evidence and giving verbal evidence in court in cases involving waste offences and their impact on the environment. She also advises public and private sector clients on regulation and compliance, having an in-depth understanding of waste legislation and its application by the regulator, and has delivered a large number of projects relating to waste and waste crime for the Environment Agency. Simone is a trusted advisor for waste market and regulatory due diligence and has used her understanding of waste data and the policy landscape to deliver feedstock and market assessments for businesses and funders to support investments and acquisitions. She has an in-depth technical understanding of waste, waste treatment, products and materials through her project work supporting procurement and providing solutions for a wide range of clients. Simone worked in waste management operations and was TCM for hazardous landfill.
Angus Nurse, Nottingham Trent University
Angus Nurse is the Head of Criminology and Criminal Justice at Nottingham Trent University. He has research interests in green criminology, corporate environmental criminality, critical criminal justice, animal and human rights law and anti-social behaviour. He is particularly interested in animal law and its enforcement and the reasons why people commit environmental crimes and crimes against animals. Angus has also researched and published on the links between violence towards animals and human violence.
