This free two-hour event will explore some key considerations for those seeking to set up, or are already involved with VCSEF (Third Sector) organisations in the early years of their journey.

The session, led by Kirsty McEwen, a leading charity and not for profit lawyer, will explore the following range of topics, with an opportunity for questions at the end of each session.

Legal Considerations, including

  • Charity or Not for Profit: what do we mean by that?
  • Understanding your structure
  • The role of Trustees

Regulatory Considerations, including

  • Charity Commission
  • Companies House
  • CIC Regulator

Financial and Other Considerations, including

  • Tax reliefs including Gift Aid
  • Financial and other reporting obligations to bodies such as the Charity Commission, Companies House and HMRC

Good Governance

What do we mean by governance and what does good governance look like, including an outline of:

  • Policies
  • Fundraising
  • Safeguarding
  • Conflicts of interest
  • Serious incident reporting

Kirsty is a Partner and Head of the tier one ranked Charity & Not for Profit team at Higgs LLP.

Kirsty is a charity Trustee and a Governor of a Preparatory School in Edgbaston and therefore has first-hand experience of the challenges and rewards of being involved in a not for profit organisation.

Kirsty and her team work for a wide range of organisations across the Third Sector, from embryonic start-ups and small social enterprises, to long established organisations, local through to national and international charities, charities that exist in isolation and those in complex group or federated structures.

Kirsty is an approved Interim Manager, sitting on the Charity Commission’s panel, acting in circumstances where there has been maladministration or management in charities, to the exclusion of the Trustees.
