The event organiser, Life Medicine Collective, has the legal responsibility to tell ticket buyers and event attendees how their personal information will be collected and used. You can find their Privacy Policy below or contact them to request it.
Terms and Conditions of Service
Parties: You will be referred to throughout these Terms and Conditions as “you”, “your” and/or “the client”. The Trustee for Ki Wellness Trust trading as Ki Wellness Pty. Ltd and The Life Medicine Collective ABN 44 915 076 231 will be referred to throughout these Terms and Conditions as “The Life Medicine Collective and Ki Wellness”.
Overview: The Terms and Conditions for The Life Medicine Collective and Ki Wellness include these Terms and Conditions, Therapeutic sessions, Events, Medical and Personal Questionnaires, Forms, Intakes and any other terms and conditions that appear in or are linked to the Life Medicine Collective website or relevant Booking Platforms, including but not limited to The Events Calendar ticketing Terms and The Events Calendar Privacy Policy (“Additional Terms and Conditions”).
Do not attend, participate, or join the members area of The Life Medicine Collective and Ki Wellness website, events, workshops or undertake therapy, or otherwise engage The Life Medicine Collective and Ki Wellness, unless you have read these Terms and Conditions and agree.
1. Treatment
1.11 Psychotherapy services are different from counselling and psychology and treatment will include a combination of evidence-based practice including, but not limited to EMDR and Acceptance and Commitment Therapy (ACT), as well as complementary healing modalities including, but not limited to Breathwork and Sound Healing. These modalities are considered complementary to traditional therapy and may be used on their own or in conjunction with each other.
1.12 Even so, positive treatment outcomes cannot be guaranteed, and it is not possible to prescribe the exact number of sessions which will be required to attain your desired outcomes.
2 Professional Fees
2.1 Consultation rates are $170 for a 50 - minute appointment or $255 for 80 - minutes incl. GST.
2.2 Reduced fees are available after discussion and pre-agreement in circumstances of genuine financial hardship.
2.3 A valid credit card will be required to be stored securely on file prior to the first session.
2.4 Unpaid sessions will be automatically billed within 24 hours of the scheduled appointment
3 Medicare Requirements / Insurers / Third Parties 3.1 Please note as a psychotherapist these sessions are not eligible for Medicare rebates. You will be required to pay for the full cost of the psychotherapy service provided. 3.2 Most third party and private health insurers are also not covered by these sessions. It is your responsibility to ensure that relevant payment arrangements have been made with insurers or other third parties.
3.3 It is your responsibility to contact your provider to determine any requirements in order for you to make a claim.
4 Booking a Session 4.1 Booking a session can be done online by going to www.lifemedicinecollective.as.me/ or directly with Dan via email. 4.2 All bookings require a minimum of 24 hours-notice. 4.3 You will receive a confirmation email upon booking, a reminder email and text message 24 hours prior to the session and a follow up reminder 1 hour before the scheduled time.
5 Cancellation Fees
5.1 For any cancellations or rescheduling of appointments, a minimum of 24 hours’ notice is required.
5.2 If less than 24 hours’ notice of cancellation is provided, the session will be forfeited, meaning this will incur a full payment.
5.3 No shows will also incur a full payment.
6 Late to Session
6.1 If after 15 minutes you are not here, or on the call, you will be contacted via text or email to remind you of the session.
6.2 If you have not contacted Dan within 30 minutes after the session has begun, the session will be forfeited. This will be counted as a "No Show" and full fee charged.
7 After Hours and Between Session Contact
7.1 Cancelation and re-scheduling must be done via; Acuity scheduling app.

7.2 Office hours are Monday - Friday (9:00am - 6:00pm AEST)
7.3 Be aware that during these times sessions are running and return contact may not be immediate. The Life Medicine Collective and Ki Wellness will endeavour to get back to you within 24 hours.
7.4 Weekends are unavailable for contact. For emergencies, please see below.
7.5 Additional services and time spent on the phone, outside of the details described above will incur additional fees charged at my hourly rate $170 p/hr pr rata.
8 Emergencies
8.1 I cannot and do not provide an emergency or on call service. If you are experiencing an emergency, please contact: Your GP's after-hours service; Lifeline 131 114, Beyond blue 1300 22 46 36, The Suicide call back service 1300 659 467. Some of these services also offer online information, and counselling.
8.2 If the emergency is immediate dial 000 or go the nearest Emergency Department
9 Limits of Confidentiality
9.1 Information obtained during provision of psychotherapy services will be safeguarded in accordance with laws protecting client confidentiality. There are however certain limits of confidentiality or circumstances where information may be disclosed:
9.2 If I receive valid written permission from you to release or disclose your information.
9.3 If I believe there is imminent and likely risk of serious bodily harm to yourself or others.
9.4 If there is reasonable suspicion of child, dependent or elder abuse
9.5 If I receive a subpoena from a Court of Law to provide documentation relating to the treatment services. In such an instance I am legally bound to comply with the request.
9.6 As a psychotherapist I am required to seek consultation from colleagues, mentors, and supervisors at times with respect to client work. If and when this occurs, client identity and details are protected and withheld, and that professional is also legally bound to keep the information shared confidential.
10 Record Keeping
10.1 Adequate records relating to treatment will be kept, and I have legal requirements concerning the collection, storage, access to and disposal of such records.
11 Reports and Correspondence
11.1 If you request additional reports or correspondence, please be aware that there will a fee for this service.
12 Other Practitioners / Modalities
12.1 As part of working with The Life Medicine Collective and Ki Wellness and its practitioners we ask that you disclose ALL practitioners, modalities, workshops, and healing events, you are currently working with, looking to work with or attend.
12.2 This is important as in some instances this may hinder or impact our progress together.
13 Timeliness & Reminders
13.1 The Life Medicine Collective and Ki Wellness and its practitioners endeavour to manage my time and not keep clients waiting. However, from time to time they may be running behind. If this occurs, they will endeavour to let you know ahead of time but if this is the case please be patient and the session will commence shortly.
13.2 In these instances, your session will be extended, and you will receive the full allotment of time (usually 50 minutes, or 80 minutes)
14 Truth-Telling Agreement in Therapy
14.1 Please tell the truth and avoid being dishonest, as it jeopardises outcomes. This does not mean you need to fully disclose and answer all questions asked of you. It is completely acceptable to say, “I don’t want to tell you” Or “I am not ready for that,” as these responses are honest and therapeutically useful.
15 Contact Information
15.1 Over the course of our professional relationship, please update us with any changes to contact details for yourself or emergency contacts as soon as possible.
16 Client Consent
16.1 Your signature indicates that you have read, understood, and accept the information in this document.
16.2 Your execution of these Terms and Conditions upon purchase of a ticket, workshop or individual therapy session evidences your consent to be governed by these Terms and Conditions.

Event Description and inclusions
The Event will be carried out as detailed in the Event Description on the Booking Page on the website. You understand that the itinerary in the event description, or as provided to you at any time by The Life Medicince Collective or Ki Wellness, is subject to the following;
17 Tickets
17.1 You will be provided with a Ticket upon executing these Terms and Conditions
17.2 Your Ticket is proof of purchase of the Event and must be presented at the time of admission.
17.3 You acknowledge that you are wholly responsible for your Ticket and that your Ticket will not be replaced or refunded in the event that your ticket is lost, damaged, stolen, destroyed or rendered unusable in anyway
17.4 Your Ticket is non-transferrable.
18 Conditions of entry
18.1 You acknowledge that your admission to an Event is subject to these Terms and Conditions
18.2 You must present a valid form of identification to be admitted entry
18.3 The Life Medicine Collective and Ki Wellness reserves the right to refuse you entry to, or remove you from, the event if you are intoxicated, under the influence of illicit drugs, inappropriately attired or acting in a manner affecting the safety or enjoyment of other participants in the Event.
18.4 If you arrive late, you may not be admitted until a suitable time is deemed appropriate if at all
18.5 No refunds will be given if you are denied access to, or removed from, the event in accordance with any of the conditions in this Clause
19 Client obligations
19.1 By purchasing a Ticket to a Life Medicine Collective Event, Workshop or Training you agree and warrant that:
19.2 You are at least 18 years of age
19.3 You have disclosed any relevant personal and medical conditions to The Life Medicine Collective, Ki Wellness and Event collaborators which may impact your capacity to participate in the Event
19.4 You will abide by the instructions provided in the Event Description, including but not limited to, instructions in relation to attire, equipment and preparation required to participate in the Event
19.5 You understand that it is not possible to guarantee that each participant will experience the same, or any, physical, emotional, or spiritual outcome as a result of participating in the Event, Workshop or Training.
20 Payment and fees
20.1 The specific Ticket Price for the Event, and what is included in that price, will be detailed in the Event Description
20.2 The total amount of the Ticket Price must be paid at the time of purchase
20.3 In addition to the Ticket Price, you must pay GST and any booking, handling, credit card surcharge or postage fees specified on the relevant Booking
21 Refunds and credits
21.1 All Ticket sales are final, and no exchange, credit or refund will be provided to you, except in the case of Cancelled Events or Postponed Events as expressly provided for in Clause 22
21.2 Any refund or credit issued will be your sole remedy for a Cancelled or Postponed Event, and The Life Medicine Collective and Ki Wellness will have no further liability to you in respect of any Cancelled or Postponed Event, or any variation of an Event, for any reason
21.3 Any credits issued for Postponed or Cancelled Events that are not used within 12 months of the original scheduled date of the Event will be cancelled
21.4 Any refunds that are processed due to exceptional circumstances will only incur the cost of the ticket. All booking fees, handling, credit card surcharge or postage fees will not be refunded
22 Cancelled, postponed, and varied Events
22.2 The Life Medicine Collective and Ki Wellness reserves the right to cancel, postpone or significantly vary an Event due to situations affecting The Life Medicine Collective and Ki Wellness, the venue or the participants, including Force Majeure Events.
23 Cancelled Events
23.1 If an Event is cancelled and a new date for the Event is not announced (“Cancelled Event”) you may elect, within 30 days of being notified of the cancellation, to obtain a refund for the Ticket Price (excluding any booking, credit card or additional fees imposed by the Booking Platform).
23.2 If you do not elect to obtain a credit within 30 days of being notified of the Event being cancelled, you will receive a credit for the Ticket Price to put towards another Life Medicine Collective and Ki Wellness Event, Workshop or Training that is scheduled to occur within 12 months of the original date of the Cancelled
24 Postponed Events
24.1 If an Event is postponed or rescheduled to a different date (“Postponed Event”) you may request in writing to info@kiwellness.com.au within 30 days of being notified of the postponement, a credit for the Ticket Price to put towards another Life Medicine Collective and Ki Wellness Event that is scheduled to occur within 12 months of the original date of the Postponed Event.
24.2 If you do not elect to obtain a credit within 30 days of being notified of the Event being postponed, your Ticket will automatically be transferred to the new date for the Postponed Event.
25 Intellectual property
25.1 You acknowledge and agree that:
25.2 Any and all right, title, and interest, including IP Rights, in any Life Medicine Collective and Ki Wellness Material vest in Life Medicine Collective and Ki Wellness upon creation;
25.3 Life Medicine Collective and Ki Wellness owns and retains all IP Rights in all Life Medicine Collective and Ki Wellness Materials
25.4 Nothing in these Terms and Conditions grants you any IP Rights in Life Medicine Collective and Ki Wellness Materials.
Life Medicine Collective and Ki Wellness acknowledges and agrees that:
25.5 You own and retain all IP Rights in all Participant Materials; and
25.6 Nothing in these Terms and Conditions grants Life Medicine Collective and Ki Wellness any IP Rights in any Participant Materials.
25.7 A party must not engage in any conduct which may challenge, damage or compromise the other party’s IP Rights in that other party’s materials (being Life Medicine Collective and Ki Wellness Materials or Participant Materials, as applicable).
26 Privacy
26.1 You acknowledge that information about you, including information provided to The Life Medicine Collective and Ki Wellness on purchasing a Ticket or attending an Event will be held by The Life Medicine Collective and Ki Wellness. This information is collected by The Life Medicine Collective and Ki Wellness for the purposes of hosting the Event.
26.2 The Life Medicine Collective and Ki Wellness does not sell or deal in personal or customer information. The Life Medicine Collective and Ki Wellness may however use your information in a general sense without reference to your name or other personally identifying information to create marketing statistics, or identify user demands to assist The Life Medicine Collective and Ki Wellness in meeting participant needs. The Life Medicine Collective and Ki Wellness may use the information that you provide to improve its website, events and general services.
26.3 The Life Medicine Collective and Ki Wellness may disclose personal information in good faith and where The Life Medicine Collective and Ki Wellness is required to do so:
26.4 Where ordered by law or a court
26.5 To enforce the terms of any The Life Medicine Collective and Ki Wellness agreements
26.6 To protect the rights, property or safety of The Life Medicine Collective and Ki Wellness, its clients or third parties; or
26.7 To banks or financial institutions with the purpose of preventing fraud as a proof of any transaction.
27 Confidentiality in Regards to Events, Workshops, Trainings and Experiences
27.1 Each party (“Receiving Party”) must keep confidential all Confidential Information given to that party by the other party (“Disclosing Party”) and must use the same degree of care to protect the Disclosing Party’s Confidential Information, as used to protect its own Confidential Information of a similar nature, but not less than reasonable care.
27.2 The Receiving Party must not disclose any Confidential Information of the Disclosing Party to any third-party unless the Receiving Party has the express written consent of the Disclosing
27.3 A party disclosing Confidential Information under clause 27.2 must use all reasonable endeavours to ensure that third parties receiving Confidential Information from that party do not disclose the information
27.4 Confidential Information does not include information to the extent:
- It is or becomes public without breach of these Terms and Conditions or otherwise through no fault of the Receiving Party.
- The Receiving Party was lawfully and demonstrably in possession of the information prior to receiving it from the Disclosing Party; or
- The Receiving Party can demonstrate the information was developed by the Receiving Party independently and without use of or reference to the Disclosing Party’s Confidential Information.
27.5 The Confidential Information of a party is the property of that Unless otherwise stated, the Receiving Party obtains no right, title, interest or licence in or to the Confidential Information of the Disclosing Party.
28 Media release and waiver
28.1 You acknowledge and agree that before and during the Event, workshop or training, you may be subject to photographs, video, sound, recordings or other media captures of your face, name, voice or likeness.
28.2 You irrevocably consent to the use, publication, distribution, broadcasting, reproduction, live-streaming, editing, recording, posting, copyrighting, licensing, digitisation and/or re-release of the Released Media by The Life Medicine Collective, Ki Wellness Pty Ltd, Daniel Zalcberg and affiliates for any legal reason or purpose, including but not limited to social media, commercial products, education, course materials, video footage, sales, marketing, or any other medium.
28.3 You understand that The Life Medicine Collective and Ki Wellness Pty. Ltd. may use all Released Media at its sole discretion and that you do not have any right to inspect or approve the use of the Released Media.
28.4 You hereby release The Life Medicine Collective and Ki Wellness Pty. Ltd from any, and all claims and demands arising out of or in connection with any use of the Released Media, including, without limitation claims for intellectual property rights.
28.5 You claim no ownership of the Released Media and forego any opportunity, whether past or present, to copyright or trademark the Released Media
29 Incorporation of other terms
29.1 The Additional Terms and Conditions that appear on The Life Medicine Collective and Ki Wellness Pty. Ltd website, and any website related to a relevant Booking Platform, will govern your use of, and participation in The Life Medicine Collective and Ki Wellness Pty. Ltd Events, workshops, and trainings, where there is Additional Terms and Conditions
29.2 Since these Additional Terms and Conditions form part of these Terms and Conditions, you are bound by the Additional Terms and Conditions and should review them wherever they are relevant to you when purchasing a Ticket or participating in an Event.
29.3 The Life Medicine Collective and Ki Wellness Pty. Ltd reserves the right to request you to sign further applicable terms and conditions, waivers, and forms which you will not unreasonably refuse to do
30 Personal Injury
30.1 You acknowledge that as a participant at a Life Medicine Collective and Ki Wellness Pty. Ltd Event, you will be exposed to all normal risks associated with but not limited to breathwork, altered-states, group participation, interpersonal relating, challenging emotions and feelings
30.2 You further acknowledge and agree that due to the nature of these types of activity, it would be unreasonable for The Life Medicine Collective and Ki Wellness Pty. Ltd to be in any way responsible for any damages, injury or death and hereby, to the fullest extent permitted by law, you waive all of your legal rights of action against and fully release The Life Medicine Collective and Ki Wellness Pty. Ltd for loss, damages, injury or death howsoever arising out of or in relation to your participation in or attendance at the Event, workshop or training, including without limitation, liability for any negligent or tortuous act or omission, breach of duty, breach of contract or breach of statutory duty on the part of The Life Medicine Collective and Ki Wellness Pty. Ltd, its officers, suppliers, contractors, directors, employees or agents.
30.3 You authorise The Life Medicine Collective and Ki Wellness Pty. Ltd, in the event of any accident or illness during the Event, workshop or training, to obtain such medical and hospital assistance as required and you agree to meet any and all expenses thereby incurred which you agree to later reimburse The Life Medicine Collective and Ki Wellness Pty. Ltd
31 Limitation of liability
To the maximum extent permitted by law:
31.1 The Life Medicine Collective and Ki Wellness Pty. Ltd liability for any breach, act or omission of The Life Medicine Collective and Ki Wellness Pty. Ltd or its personnel in the performance of these Terms and Conditions (whether based in contract, tort including negligence, common law, equity, statute or otherwise) is limited in aggregate to the total Ticket Price paid by you to The Life Medicine Collective and Ki Wellness Pty. Ltd;
31.2 The Life Medicine Collective and Ki Wellness Pty. Ltd excludes any liability for indirect, economic, special, or consequential loss or damage; and
31.3 A party’s liability under these Terms and Conditions, including any indemnity, will be reduced to the extent that the other party caused or contributed to the relevant loss or
32 Indemnity
32.1 You indemnify The Life Medicine Collective and Ki Wellness Pty. Ltd (and each of its officers, employees, contractors, consultants, and agents) (“Indemnified Parties”) and must keep the Indemnified Parties indemnified against all loss, damage (including indirect and consequential loss and damage), claims, liability, expense, payment and/or outgoings incurred by or awarded against you and arising directly or indirectly from:
- Non-performance of these Terms and Conditions
- Any unlawful, wilful or negligent act or omission by you, your employees, officers, agents, consultants or contractors in connection with the Event under these Terms and Conditions
- a breach or default by you of your obligations (or any warranty) under these Terms and Conditions
- Any infringement of the IP Rights of The Life Medicine Collective and Ki Wellness Pty. Ltd, or any infringement of the IP Rights of Third-Party Materials caused or contributed to by you or your agents, employees, contractors (other than The Life Medicine Collective and Ki Wellness Pty. Ltd), consultants or officers
- Damage to personal property
- Injuries suffered by you or any person working within or in affiliation with your business in relation to the Events carried out under these Terms and
33 No guarantees or Warranties
33.1 To the maximum extent permitted by law, the Events carried out under these Terms and Conditions are provided without guarantee, warranty or representation as to the accuracy, reliability or completeness of any information provided during the Event or any success or outcome of the
33.2 In particular, The Life Medicine Collective and Ki Wellness Pty. Ltd does not guarantee, warrant or represent that the Events carried out under these Terms and Conditions will achieve any specific result for you, including mental, physical, emotional or spiritual
34 Competition law
34.1 The Life Medicine Collective and Ki Wellness Pty. Ltd complies with Australian Consumer Law and provides all the Consumer Guarantees contained in the Competition and Consumer Act 2010 (Cth) to the extent they are applicable. Where The Life Medicine Collective and Ki Wellness Pty. Ltd breaches a warranty or guarantee which is implied by law into these Terms and Conditions and which cannot be lawfully excluded, then The Life Medicine Collective and Ki Wellness Pty. Ltd relies on section 64A of the Competition and Consumer Act 2010 (Cth).
Accordingly, The Life Medicine Collective and Ki Wellness Pty. Ltd liability for any such breach shall be limited at The Life Medicine Collective and Ki Wellness Pty. Ltd option, as long as it is fair and reasonable to do so, to any one or more of the following:
- where there is a supply of goods, to the replacement or resupply of equivalent goods, or payment of the cost of replacing the goods or acquiring equivalent goods; or
- where there is a supply of services, to resupplying the services or payment of the cost of having the services
35 Disputes
35.1 Either party may give a notice in writing to the other party stating the details of a dispute between the parties (“Notice of Dispute”)
35.2 Representatives of the parties having authority to settle the dispute must meet within seven (7) days receipt of the Notice of Dispute to attempt to resolve the dispute. If the representatives cannot do so, either party may commence court proceedings in respect of the issues outlined in the Notice of Dispute
35.3 Nothing in this clause prevents a party from commencing proceedings to seek urgent interlocutory relief.
36 Right to sub-contract
36.1 The Life Medicine Collective and Ki Wellness Pty. Ltd may appoint contractors or agents to facilitate all or part of the Event.
37 Assignment
37.1 Neither party may assign or novate these Terms and Conditions or a right or obligation under these Terms and Conditions without the prior written consent of the other party
38 Variation
38.1 Any variation, amendment or modification of these Terms and Conditions will not be effective unless agreed between the parties in writing (including electronic communication)
38.2 All changes are effective from the date they are made and your continued participation in The Life Medicine Collective and Ki Wellness Pty. Ltd Events will constitute your acceptance of the variation of the Terms and Conditions. It is your responsibility to ensure you are aware of any changes to these Terms and Conditions
39 Severability
39.1 Any provision of these Terms and Conditions which is prohibited or unenforceable will be interpreted as narrowly as necessary to allow it to be valid or enforceable, and if such narrow interpretation is not sufficient to make the clause enforceable or valid, then the provision will be severed from these Terms and Conditions without invalidating the remaining provisions.
40 Notices
40.1 Any notice, or other communication to be given by either party under these Terms and Conditions shall be deemed to have been duly given if it is in writing, signed for and/or on behalf of the concerned party and delivered under acknowledgment due at info@kiwellness.com.au or as advised from time-to-time hereafter in writing by a party to the other.
41 Counterparts
41.1 These Terms and Conditions may be executed in any number of counterparts and by the parties on separate counterparts. Each counterpart constitutes the agreement of each party who has executed and delivered that counterpart.
42 Entire agreement
42.1 This Terms and Conditions is the entire agreement between the parties about its subject matter and replaces all previous agreements, understandings, representations and warranties about that subject matter.
43 Jurisdiction
43.1 These Terms and Conditions are to be governed by and construed according to the laws in force in the state of Queensland and Victoria, Australia, and the parties agree to the exclusive jurisdiction of the courts of Queensland and Victoria.
44 General
44.1 Nothing in these Terms and Conditions is intended to constitute a fiduciary relationship or an employment, agency, partnership or trust, and no party has authority to bind any other party.
44.2 You must do such further acts and things and execute such further documents as may be necessary in the reasonable opinion of The Life Medicine Collective and Ki Wellness Pty. Ltd to give effect or better effect to the provisions of these Terms and Conditions.
45 Definitions
45.1 Unless the context requires otherwise, capitalised terms not defined in the Terms and Conditions should be given their regular meaning.
Additional Terms and Conditions means the Event Description, the Medical Questionnaire, Client Intake, Personal History and any other forms or terms and conditions that appear in or are linked to The Life Medicine Collective and Ki Wellness Pty. Ltd website or relevant Booking Platforms, including but not limited to the The Events Calendar Terms and The Events Calendar Privacy Policy.
Booking Platform means the The Life Medicine Collective and Ki Wellness Pty. Ltd Website www.thelifemedicinecollective.com, The Events Calandar www.theeventscalendar.com, and Humanitix www.humanitix.com or any other booking platform from which you can purchase a Ticket to a Life Medicine Collective and Ki Wellness Pty. Ltd Event.
Confidential Information includes the terms and conditions of these Terms and Conditions (but not its existence) and any information provided by a party to the other which is, or can be inferred to have been, provided in commercial confidence or of a confidential nature, whether or not expressly marked “confidential”, including any information relating to the commercial activities, technologies, business processes, client, partner or supplier relationships, strategic information, know-how and any other information regarding the business of the Disclosing Party.
Disclosing Party means the party disclosing Confidential Information.
Event means the event, workshop, training, retreat, journey or experience hosted by The Life Medicine Collective and Ki Wellness Pty. Ltd, including One-to-One sessions, Group Sessions, Group Workshops and Facilitator Training Sessions, as detailed by the Event Description on the Booking Platform.
Event Description means details provided on the Booking Platform about the Event, including price, time, location, and the relevant instructions in relation to the following, including but not limited to the preparation, itinerary, attire, equipment, transportation, meals, amenities and integration required to participate in the Event.
Force Majeure Event means any of the following, whether or not foreseeable or anticipated: acts of God, terrorism, war, civil unrest, strike or labour dispute, lack of transportation, breakdown, labour or material shortage, blockade or embargo, supplier failure, epidemic or pandemic, government restriction or recommendation, legal requirement, extreme weather, earthquake, drought, fire, flood, explosion, natural disaster, and/or any other event, cause or circumstance that is beyond Spirit Breathwork’s reasonable control.
Group Session means the event, workshop, retreat, journey or experience hosted by The Life Medicine Collective and Ki Wellness Pty. Ltd, available to members of the general public to attend to participate in but not limited to breathwork and sound healing, with the guidance of trained facilitators.
Intellectual Property Rights (“IP Rights”) means any intellectual and industrial property rights or entitlements throughout the world including those in connection with any Confidential Information, copyright (including future copyright and rights in the nature of or analogous to copyright), moral rights, inventions (including patents), trademarks, service marks and designs, whether or not now existing and whether or not registered or registrable, as well as any right to apply for the registration, renewals and extensions of those rights, and any other Intellectual Property Rights as defined in Article 2 of the World Intellectual Property Organisation Convention of 1967.
Medical Questionnaire means the questionnaire provided to you either physically or online before attending a Life Medicine Collective and Ki Wellness Pty. Ltd Event which includes your personal and medical information.
Client Intake Questionnaire means the questionnaire provided to you either physically or online before attending a Life Medicine Collective and Ki Wellness Pty. Ltd Event which includes your personal and medical information
Journey Intake Questionnaire means the questionnaire provided to you either physically or online before attending a Life Medicine Collective and Ki Wellness Pty. Ltd Event which includes your past experiences, challenges, goals and aspirations
Participant Materials means any trademarks, images, content or other materials developed by you prior to the date of the Event or independently of these Terms and Conditions.
Receiving Party means the party receiving Confidential Information from the Disclosing Party.
Released Media includes, but is not limited to, all photographs, videos, sound recordings, paintings, sculptures, and all other media currently known or hereinafter developed, captured of you or your likeness before and during the Event by The Life Medicine Collective and Ki Wellness Pty. Ltd. or any of The Life Medicine Collective and Ki Wellness Pty. Ltd employees, affiliates, associates, representatives or agents.
The Life Medicine Collective and Ki Wellness Pty. Ltd Materials means any material, including any documents, presentations, leaflets, or brochures provided by The Life Medicine Collective and Ki Wellness Pty. Ltd. during an Event, as well as any derivative work created or developed in the performance of these Terms and Conditions by The Life Medicine Collective and Ki Wellness Pty. Ltd either in isolation or jointly with you, but excludes Third-Party Materials. Third-Party Materials means any content, including texts or images, created by a party other than The Life Medicine Collective and Ki Wellness Pty. Ltd. or you.
Ticket means a ticket to a Life Medicine Collective and Ki Wellness Pty. Ltd Event including:
1. physical tickets received via email or collected on site; and
2. e-tickets, print-at-home or email confirmations serving as tickets to gain entry to an Event.
Ticket Price means the amount payable by you to The Life Medicine Collective and Ki Wellness Pty. Ltd to attend the Event, as detailed on the Event Description.
46 Interpretation
46.1 Details to legislation or provisions of legislation include changes or re-enactments of the legislation and statutory instruments and regulation issues under the legislation;
46.2 Words denoting the singular include the plural and vice versa, words denoting individuals or persons include bodies corporate and vice versa, details to documents, agreements or terms and conditions also mean those documents, agreements or terms and conditions as changed, novated or replaced, and words denoting one gender include all genders;
46.3 Grammatical forms of defined words or phrases have corresponding meanings;
46.4 Parties must perform their obligations on the dates and times fixed to the capital city of the Jurisdiction;
46.5 Details to an amount of money refers to the amount in the lawful currency of the Commonwealth of Australia;
46.6 If the day on or by which anything is to be done is a Saturday, a Sunday or a public holiday in the place in which it is to be done, then it must be done on the next business day;
46.7 Details to a party are intended to bind their executors, administrators and permitted transferees;
46.8 Obligations under these Terms and Conditions affecting more than one party bind them jointly and each of them severally; and
46.9 The terms and conditions herein replace any other terms and conditions of engagement that may have applied prior to the date of these Terms and conditions.
