This Privacy Policy explains how Palgrave Penguins Swim School (“we”, “us”, “our”) collects, uses, shares, and protects personal information when you use our online booking and registration website, forms, and related services (the “Services”). Payment Information

  • Payments are made by e‑transfer to our designated email address.
  • We do not collect or store your banking passwords or full financial account details; these are handled by your own bank or financial institution through its secure systems.​

CANCELLATIONS

Inclement Weather: During inclement weather, the swim school makes every effort to keep the pool open for as long and as safely as possible. Lessons will continue during periods of light rain or showers. Your swim instructor will decide when to end or cancel a lesson upon any sign of thunder/lightning/other severe weather, and will communicate this with you, as soon as possible. On the rare occasion that severe weather may cause our pool to close, your swim instructor will reschedule a cancelled lesson as soon as possible.

Cancellation Policy: We understand that circumstances beyond your control may cause you to miss a class, these things happen.  We do not reschedule or credit missed classes. Not to worry, a missed lesson or two during a block won’t hinder your swimmer’s progress.

We know that families have a lot of schedules to juggle! If you need to change your scheduled swim time, and if there is space available, we would be happy to help you find another time that fits your schedule.

Students who cancel up to 30 days prior to the first day of lessons will be issued a 75% refund. Students who cancel less than 30 days prior to the first day of lessons will be issued a 75% monetary credit to be used toward future programming.

COMMUNICATION

Email: I agree that Palgrave Penguins Swim School may send me email messages to the email address that I have provided. I understand that message frequency varies. I further understand that I may reply UNSUBSCRIBE to cancel future email messages.

Text Messaging: I agree that Palgrave Penguins Swim School may send me text messages to the mobile phone number that I have provided. I understand that message frequency varies, and that message and data rates may apply. I further understand that I may reply STOP to cancel future text messages.

RELEASE OF LIABILITY

I and Participants understand that participation in Palgrave Penguins Swim School activities is voluntary, and that it is a revocable privilege. I and Participants understand the importance of accurately answering the preceding questions about medical and/or learning conditions. I and Participants understand that participation in Palgrave Penguins Swim School activities can be strenuous, and requires considerable exertion and physical stress. I hereby represent and certify that I and any Participant for whom I am executing this Agreement do not suffer from any physical or psychological conditions that would prevent myself or Participants from participating in Palgrave Penguins Swim School activities.  In consideration for being permitted to participate in Palgrave Penguins Swim School activities, I and Participants AGREE to the fullest extent allowed by the law, TO RELEASE FROM LIABILITY AND TO NEVER SUE PALGRAVE PENGUINS SWIM SCHOOL, its affiliates, representatives, owners, investors, members, managers, officers, directors, employees, instructors, trainers, independent coaches, agents, landowners, landlords, subsidiaries, franchisees, contractors, affiliated companies or entities, successors, heirs and assigns (collectively referred to in this Agreement, "Palgrave Penguins Swim School" ) as well as the owners, sellers, manufacturers and installers of equipment comprising Palgrave Penguins Swim School, and therefore release and HOLD PALGRAVE PENGUINS SWIM SCHOOL HARMLESS for any damage, injury or death to me or Participants arising from my or Participants' participation in Palgrave Penguins Swim School activities, regardless of cause, including the NEGLIGENCE, GROSS NEGLIGENCE, OR STRICT LIABILITY OF PALGRAVE PENGUINS SWIM SCHOOL.

The Participant (“Swimmer”) and guests who have reached the age of majority, or if under 18, his or her Parent or Guardian, understand and acknowledge that participation in swimming lessons and related activities involves certain inherent risks and potential hazards. In consideration of participating in swimming lessons provided by 16029515 Canada Inc. ("the Corporation") o/a Palgrave Penguins Swim School ("the Swim School"), I agree to the following terms:  I voluntarily assume all risks associated with swimming activities, including but not limited to the risk of drowning, near-drowning incidents, paralysis, death, injuries resulting from slips, falls, collisions, or other accidents that may occur anytime, whether prior to, during, or after lesson time, while on the property where the swim school operates (“the property”).  I hereby release, discharge, and hold harmless the Corporation and its affiliates, officers, directors, agents, stockholders, successors, employees and their family members, the swim school, Joshua Kroeplin, and the home owners/the property owners from any and all claims, demands, actions, or causes of action, whether past, present, or future, whether arising from negligence or otherwise, for damage, personal injury, or wrongful death that may occur to the participant, the guest, or parent or guardian as a result of participation in swim lessons and/or any other time while on the property. This release binds my heirs, successors, and assigns.

I, the undersigned, hereby affirm that I have provided written notice to the swim school regarding any existing medical or health conditions of which the instructor should be made aware.  If the Participant / Swimmer is a minor, the Participant’s parent or guardian or caregiver must be present at the lesson location for the duration of the lesson. The instructor reserves the right to cancel or end a lesson if no parent or guardian or caregiver is present, and the lesson will not be rescheduled.  The swim school is not responsible for the supervision of the participant, or any child, outside of his or her lesson time.

I hereby consent to the use of electronic communications, electronic records, and electronic signatures. I have read and understood this liability release, and I voluntarily sign it with the intention of being legally bound hereby. I agree that my electronic signature below authenticates this form, is legally binding, and has the same force and effect as a manual signature on a paper document.

Palgrave Penguins Swim School routinely takes photographs and videos for commercial purposes, and patrons may be readily identifiable in these images and/or videos. I further grand exclusive permission to Palgrave Penguins Swim School to use my or Participants' names, faces, likenesses, voices or appearances in photographs or videos in connection with publicity, advertising, promotional materials or other commercial purposes without compensation and without restriction as to frequency and duration. I further agree that Palgrave Penguins Swim School may temporarily provide online access to photographs, videos, and live streams of my and Participants' experience.

By executing this Agreement, I declare under penalty of perjury that I am doing so only for myself and/or Participants for whom I am authorized. If I execute this Release of Liability and Indemnity Agreement on behalf of another person, I understand and agree that I am acting as the agent for that person, and my signature expressly confirms that I have permission to sign on the other person's behalf, and this Agreement shall be binding upon that person if the other person brings a claim or lawsuit against Palgrave Penguins Swim School. I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS PALGRAVE PENGUINS SWIM SCHOOL as fully set forth above. If I sign without the express permission of any other person, I understand and agree that I am committing fraud against Palgrave Penguins Swim School. I understand that this RELEASE OF LIABILITY will prevent me and Participants from filing suit or making any claim for damages in the event of any loss, injury or death arising from participation in Palgrave Penguins Swim School activities. I and Participants understand that this is a release of liability that will apply whenever I or Participants engage and/or participate in Palgrave Penguins Swim School activities. If I or Participants or any legal representative files a claim for lawsuit arising out of my or Participants' participation in Palgrave Penguins Swim School, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS PALGRAVE PENGUINS SWIM SCHOOL for any damages, attorney's fees or costs arising out of such claim or a lawsuit. With a full understanding of this Agreement, I nevertheless enter into this Agreement freely and voluntarily and agree that it is binding upon me and Participants, and our heirs, assigns and legal representatives.  In the event of a medical emergency, I authorize Palgrave Penguins Swim School to provide emergency first aid treatment and/or to refer treatment to a duly licensed physician, dentist or other medical care professional. This care may be given under whatever conditions are necessary to preserve the life, limb, or well-being or myself or Participants for whom I am executing this Agreement.  I agree not to sue or make any claims against the Corporation, the Swim School, Joshua Kroeplin, or any employee or family members, liable for any injuries, damages, losses, or liabilities that may arise from my and/or my child's participation in swim lessons, or any time while on the property. I understand that this contract is between me, Joshua Kroeplin, the corporation, and the swim school, and that the home owners/the property owners are not party to this contract.  I UNDERSTAND THAT I VOLUNTARILY GIVE UP MY RIGHT TO SUE THE ABOVE MENTIONED PARTIES FOR ANY REASON WHATSOEVER.

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY AND INDEMNITY AGREEMENT IN ITS ENTIRETY, AND HAVE BEEN PROVIDED THE OPPORTUNITY TO ASK QUESTIONS AND CONSIDER THE EFFECTS OF THIS AGREEMENT. IN CONSIDERATION FOR AND IN EXCHANGE FOR EXECUTING THE AGREEMENT, PALGRAVE PENGUINS SWIM SCHOOL IS PERMITTING ME AND PARTICIPANTS TO VOLUNTARILY PARTICIPATE IN PALGRAVE PENGUINS SWIM SCHOOL ACTIVITIES. I ACKNOWLEDGE AND FULLY UNDERSTAND THAT THIS AGREEMENT IS BINDING UPON ME AND ALL PARTICIPANTS, ASSIGNS, AND LEGAL REPRESENTATIVES. I ACKNOWLEDGE THAT THIS AGREEMENT IS SEVERABLE AND THAT IF ANY CLAUSE IS FOUND TO BE INVALID, THE OFFENDING CLAUSE WILL BE STRICKEN AND THE BALANCE OF THE AGREEMENT WILL REMAIN IN EFFECT AND WILL BE ENFORCEABLE. I agree that any action arising from or related to this Agreement will be subject to and interpreted under the Province and Federal laws. I understand that this Release of Liability and Indemnity Agreement is VALID FOREVER, and shall have full force and effect whenever I or Participants participate in Palgrave Penguins Swim School activities.
