Privacy Policy for Star Entertainment GmbH


Introduction

This policy sets out how we collect, process and hold your personal data if you visit our event ticket shop or otherwise provide personal data to us. We are Star Entertainment – Prod.-, Vermittlungs- u. Veranst. GmbH of Bittenfelder Weg 4, 55545 Bad Kreuznach, Germany. We are the data controller of your personal data.

This policy affects your legal rights and obligations so please read it carefully. If you have any questions, please contact us at info@star-entertainment.eu.

Personal data we collect

We collect, process, store and use personal data when you book a ticket and buy any of our associated products and services to an event including your name, address and email address together with payment information. We may also collect personal data that you give to us about other people if you register them to attend an event. You agree that you have notified any other person whose personal data that you provide to us of this privacy notice and, where necessary, obtained their consent so that we can lawfully process their personal data in accordance with this policy.

All personal data that you provide to us must be true, complete and accurate. If you provide us with inaccurate or false data, and we suspect or identify fraud, we will record this.

You do not need to provide us with any personal data to view our event ticket shop. However, we may still collect the information set under the Data we automatically collect section of this policy, and marketing communications in accordance with the Marketing Communications section of this policy.

When you contact us by email or post, we may keep a record of the correspondence and we may also record any telephone call we have with you.

Data we automatically collect

When you visit our event ticket shop, we, or third parties on our behalf, automatically collect and store information about your device and your activities. This information could include (a) your computer or other device's unique ID number; (b) technical information about your device such as type of device, web browser or operating system; (c) your preferences and settings such as time zone and language; and (d) statistical data about your browsing actions and patterns. We collect this information using cookies in accordance with the Cookie section of this policy and we use the information we collect on an anonymous basis to improve our event ticket shop, our events and the products and services we provide, and for analytical and research purposes.

We also allow advertisers and advertising networks to collect information about your computer or mobile device, activities, and geographic location to enable them to display targeted ads to you and provide us with anonymous information about our users' behaviour. Again, this takes place through the use of cookies in accordance with the Cookie section of this policy.

Marketing Communications

If you opt in to receive marketing communications from us you consent to the processing of your data to send you such communications, which may include newsletters, blog posts, surveys and information about new events. We retain a record of your consent.

You can choose to no longer receive marketing communications by contacting us at info@star-entertainment.eu or clicking unsubscribe from a marketing email. If you do unsubscribe to marketing communications, it may take up to 5 business days for your new preferences to take effect. We shall therefore retain your personal data in our records for marketing purposes until you notify us that you no longer wish to receive marketing emails from us.

Lawful processing of your personal data

We will use your personal data in order to comply with our contractual obligation to supply to you your tickets to an event and any associated products and services, including to contact you with any information relating to the event or your purchases, to deliver the event and your purchases to you in accordance with any requests you make and that we agree to, and to deal with any questions, comments or complaints you have in relation to the event or your purchases.

We may also use your personal data for our legitimate interests, including dealing with any customer services you require, enforcing the terms of any other agreement between us, for regulatory and legal purposes (for example anti-money laundering), for audit purposes and to contact you about changes to this policy.

Who do we share your data with?

We may share your personal data with any service providers, sub-contractors and agents that we may appoint to perform functions on our behalf and in accordance with our instructions, including payment providers, event ticketing providers, email communication providers, IT service providers, accountants, auditors and lawyers.

Under certain circumstances we may have to disclose your personal data under applicable laws and/or regulations, for example, as part of anti-money laundering processes or to protect a third party's rights, property, or safety.

We may also share your personal data in connection with, or during negotiations of, any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

Where we hold and process your personal data

Some or all of your personal data may be stored or transferred outside of the European Union (the EU) for any reason, including for example, if our email server is located in a country outside the EU or if any of our service providers or their servers are based outside of the EU. We shall only transfer your personal data to organisations that have provided adequate safeguards in respect of your personal data, in accordance with the requirements of the EU General Data Protection Regulation (GDPR).

Cookies

A cookie is a small text file containing a unique identification number that is transferred (through your browser) from a website to the hard drive of your computer. The cookie identifies your browser but will not let a website know your name and/or address. These files are then used by websites to identify when users revisit that website.

Our event ticket shop uses cookies so that we can recognise you when you return and personalise your settings and preferences. Most browsers are initially set up to accept cookies. You can change your browser settings either to notify you when you have received a cookie, or to refuse to accept cookies. Please note that our event ticket shop may not operate efficiently if you refuse to accept cookies.

We also use Google Analytics to monitor how the event ticket shop is used. Google Analytics collects information anonymously and generates reports detailing information such as the number of visits to the event ticket shop, where visitors generally came from, how long they stayed on the event ticket shop, and which pages they visited. Google Analytics places several persistent cookies on your computer's hard drive. If you do not agree to this you can disable persistent cookies in your browser. This will prevent Google Analytics from logging your visits.

Security

We shall process your personal data in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures. All information you provide to us is stored on our secure servers. Any payment transactions are encrypted using SSL technology.

Where we have given, or you have chosen a password, you are responsible for keeping this password confidential.

However, you acknowledge that no system can be completely secure. Therefore, although we take these steps to secure your personal data, we do not promise that your personal data will always remain completely secure.

Your rights

You have the right to obtain from us a copy of the personal data that we hold for you, and to require us to correct errors in the personal data if it is inaccurate or incomplete. You also have the right at any time to require that we delete your personal data, to restrict or object to the processing of your personal data, and to data portability, in accordance with the GDPR. To exercise these rights, or any other rights you may have under applicable laws, please contact us at info@star-entertainment.eu.

Please note, we reserve the right to charge an administrative fee if your request is manifestly unfounded or excessive.

If you have any complaints in relation to this policy or otherwise in relation to our processing of your personal data, you should contact the competent German supervisory authority. For our establishment, this is Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Rheinland-Pfalz (see www.datenschutz.rlp.de). You may also lodge a complaint with the supervisory authority in the EU member state of your residence or place of work.

Our event ticket shop may contain links to other sites of interest. Once you have used these links to leave our event ticket shop, you should note that we do not have any control over that other site. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this policy. You should exercise caution and look at the privacy policy applicable to the site in question.

Retention

If you register with us, we shall retain your personal data until you close your account.

If you receive marketing communications from us, we shall retain your personal data until you opt out of receiving such communications.

If you have otherwise booked a ticket or associated products and services with us or contacted us with a question or comment, we shall retain your personal data for 6 months following such contact to respond to any further queries you might have.

General

If any provision of this policy is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.

This policy shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, and you agree to submit to the jurisdiction of the courts of Bad Kreuznach, Germany, to the extent permitted by law.

We may change the terms of this policy from time to time. You are responsible for regularly reviewing this policy so that you are aware of any changes to it. If you continue to use our event ticket shop after the time we state the changes will take effect, you will have accepted the changes.

(1) These General Terms and Conditions (“GTC”) shall apply to all orders for tickets for events, shows, parties and events organised by Star Entertainment (“our”, “we”,”us”).

(2) Our deliveries, services, and offers are made exclusively on the basis of these GTC. We do not recognize any terms and conditions that contradict or deviate from our GTC unless we explicitly agree to their validity in writing.

‍§ 1 General
(1) The offers by Star Entertainment Productions LDA constitute a non-binding invitation to you to order tickets via the external ticket platform, Ticket Tailor ("our ticket platform", "the ticket platform")

(2) Via the ticket platform, you can purchase tickets for Star Entertainments services. By clicking on the button “Place order” you are making a binding purchase offer. A purchase contract for the goods is only occurring, if we explicitly declare acceptance of the purchase offer or if we deliver the ordered ticket(s).

(3) For details on the ticket purchasing process on other platforms, please refer to their terms and conditions.

(4) If you are acting on behalf of a third party (e. g. for a company that wants to purchase tickets via the ticket platform), you must be authorized to act on behalf of the third party.

(5) We are not liable for any damage or problems caused by tickets sold or bought on non-authorized platforms. Only original tickets purchased on authorized ticket platforms are guaranteed entry to our events. Buying via other channels includes a risk of buying invalid tickets, on which we do not have any influence and do not take any responsibility for.

‍§ 2 Prices
‍The prices quoted on the event pages include the statutory VAT and other price components. Ticket fees and other fees might be added on the checkout page.

§ 3 Restrictions
‍We are interested in restricting the passing on of tickets to third parties in order to avoid criminal acts in connection with the attendance of the events and to prevent the resale of tickets at excessive prices.
(1) Therefore, it is not allowed to sell tickets to third parties at a price higher than the price of the ticket, including handling charges, as shown on our ticket platform; and to sell tickets commercially or to use them publicly for advertising and/or marketing purposes without our express prior written consent.

(2) In the event that you violate the provisions of § 3.1 (1), we may terminate the existing legal relationship with you with immediate effect. The ticket(s) for the respective event will then be blocked and cannot be used anymore.

(3) Furthermore, we shall be entitled to demand a contractual penalty in an appropriate amount per violation of the provisions of paragraph § 3.1 (1) for passing on tickets for events to third parties and/or offering them, unless the violation has occurred through no fault of your own. Further claims for damages shall remain unaffected.

‍§ 4 Terms of payment;

Default of payment
‍(1) Payment by credit card, PayPal, Klarna, Apple Pay, Google Pay, LINK, BLIK, Bancontact, EPS and iDEAL is available as means of payment.

(2) The total price of your order is due immediately upon order.

(3) If you are in arrears with a payment, you are obliged to pay the statutory default interest in the amount of 5 percentage points above the base rate. For each reminder sent to you after the default has occurred, you will be charged at least a reminder fee of EUR 5, unless you can prove a lower damage.

‍§ 5 Offsetting / Retention
‍(1) You are only entitled to set-off if your counterclaim has been legally established or is not disputed by us.

(2) You can only exercise a right of retention if your counterclaim is based on the same contractual relationship.

‍§ 6 Delivery
‍(1) Unless otherwise agreed, the delivery of the ticket will be made by email, to the email address provided by you in the checkout process.

‍§ 7 Right of withdrawal
‍There is no right of withdrawal for tickets. If not explicitly stated, they are also excluded from redemption or exchange.

§ 8 Programming
Any artists appearing or mentioned on the ticket platform, website, social media or marketing material are not guaranteed to appear and we reserve the right to make changes in the line-up, appearance and content at any time. Shows might start later than announced due to unforeseen circumstances. Shows might end earlier or later than announced due to unforeseen circumstances or changes to the show.

‍§ 9 Admission
‍(1) The sent ticket(s) are checked at the entrance to the event. If the bar code or the QR code and all other details on the ticket are not clearly legible, there is no entitlement to admission to the event or refund of the ticket. The first ticket holder will be admitted to the event. The ticket will then be blocked for further access. Only tickets purchased through official distribution channels are valid. Changing or imitating the tickets is prohibited.

(2) The guest may not take any items (e. g. fireworks, knives, glass bottles) to the event whose possession or use endangers the other event visitors, artists, or other present ones. If a guest carries such items with him, he will be denied entry. If, for this reason, the entry is given away, there is no right to a replacement or refund of the ticket.

(3) The guest commits at all times to observe all safety and implementation regulations and to follow instructions from the security and event staff.

(4) We may refuse the guest access to the event without compensation or exclude him from the event (during the event), if the event visitor does not comply with the safety and / or implementation regulations of the organizer or his assistants.

(5) Special regulations may apply to individual events (such as minimum age, dress code), which we will explicitly point out on the ticket platform before purchasing the respective tickets to the events. If the stated regulations are not adhered accordingly, entry may be refused by the auxiliary personnel. A refund of the ticket(s) is not possible in that case. For any uncertainty regarding your dress code, you can contact info@star-entertainment.eu prior to the event.

(6) Each ticket only grants access to the respective event for one person, unless stated differently on the ticket.

‍§ 10 Lost items, program and health damage
‍(1) Unfortunately, we cannot accept any liability for lost or stolen objects at the events, whereas the regulation in section § 13 (Liability) remains unaffected.

(2) Please note that the programme of the individual events may be subject to change with regard to the performances and/or decorations. Such changes do not constitute a right to redemption or exchange of tickets for the event in question.

(3) The visitor is aware that events with shows, light effects and live music are particularly loud and that there is a risk of possible health damage, especially hearing damage. It is recommended to use ear plugs, especially when staying close to the speakers, and to visit a place on the event area that meets the individual listening habits.

(4) You understand and agree that some events may carry inherent risk, and by participating in those events, you choose to assume those risks voluntarily. For example, some events may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those events.

‍§ 11 Cancellation / bad weather regulations
‍(1) Due to weather or other influences, there may be interruptions or delays at events. If an event is canceled more than 2 hours after the official start, the event will be deemed to have taken place (no refund or exchange of tickets).

(2) For events that are canceled or shorter than two hours, a replacement date for the event is called. The tickets are valid for the replacement date. If no replacement date is mentioned, the ticket price will be refunded. The refund might be reduced by shipping costs, payment provider fees and/or ticket platform fees. As an alternative your ticket can be exchanged for a ticket of the same value.

(3) With the exception of the cases described in paragraphs 1 and 2, the customer has no claims against the organizer in the event of premature termination or cancellation of the event due to events for which the organizer is not responsible (in particular third-party fault). That includes no claims for compensation, a replacement date for the event, an exchange or a refund claim.

‍§ 12 Copyrights
‍(1) Sound and film recordings of any kind are prohibited for copyright reasons. Commercial image and sound recordings require the prior written consent of the organizer. If these rules are not followed, the ticket purchaser can be excluded from the event without compensation.

‍§ 13 Data protection
‍We comply with the legal basis of data protection. Our data protection declaration can be viewed at any time via the ticket platform.

‍§ 14 Liability
‍(1) Unlimited liability: We are fully liable for intent and gross negligence. For slight negligence we are liable for damages resulting from injury to life, limb and health of persons.

(2) In other respects, the following limited liability shall apply: In the event of slight negligence, we shall only be liable in the event of a breach of an essential contractual obligation, whose fulfilment is essential for the proper fulfilment of the contract and on whose compliance you may regularly rely on. The liability for slight negligence is limited in amount to the damages foreseeable at the time of conclusion of the contract, with whose formation must typically be calculated. This limitation of liability shall also apply in favour of our representatives, employees and vicarious agents.

(3) The liability for consequential damages, such as loss of profit or similar indirect damage and compensation for useless expenses is excluded.

(4) We strive to provide a permanent and efficient service via the ticket platform. However, possible service failures due to malfunctions or maintenance work cannot be ruled out and do not represent a contractual breach. We are further entitled to change the offer on the ticket platform at any time. Such changes do not constitute a contractual breach.

(5) We shall not be liable for inadequate performance of services due to events beyond our control. These include, but are not limited to force majeure, computer viruses, acts of terrorism, public unrest, war, strikes, fire, power outages or epidemics.

‍§ 15 Photo- and video recordings for advertising purposes
‍(1) Photographs and videos will be taken throughout the event. These recordings can be used for advertising purposes by us or any of our partners. If you do not agree to the utilization, please contact the auxiliary personnel of the organizer. Should this not happen, we assume that you permit us to use the recordings free of charge.

(2) Own photos and films may be taken for private purposes, provided that other guests are not impaired or disturbed. Professional photo and video recordings for commercial use are only permitted with our prior written consent. The “posting” of the pictures for private purposes on social networks such as Instagram, Facebook, or similar is desired, provided that the personal rights of other guests are not violated, the material does not misrepresent the event and the published material does not harm us.

‍§ 16 Modification of the General Terms and Conditions
‍(1) We reserve the right to amend these General Terms and Conditions at any time, in particular to implement legal requirements. Changes will be notified to you by e-mail or in writing at the latest four (4) weeks before they take effect. If you do not object to the validity of the new GTC within four (4) weeks after receipt of the notification, the amended GTC are considered as accepted. We will point out the significance of this period in the amendment notification separately.

(2) If you object within the four (4) weeks, the contractual relationship between you and us shall continue to exist under the present terms and conditions.

‍§ 17 Final clauses
‍(1) Should one or more provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The ineffective points will be replaced by the legal regulations, if applicable.

(2) Contracts between us and you shall be governed exclusively by Portuguese law to the exclusion of the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the country in which you as a consumer have your habitual residence, remain unaffected.
