Acknowledgement of Risk, Waiver, and Release of Liability - Pre-season events
TERMS GOVERNING IN-PERSON PRE-SEASON EVENTS:
I understand and acknowledge that participation in the events or programs operated or conducted by Steve & Kate's Camp LLC (the "Camp"), including all of the activities and the use of facilities and equipment, involves an inherent and unavoidable risk of injuries, harm, and loss. I understand that, although the Camp takes precautions to provide proper organization, supervision, and equipment, it is impossible for the Camp to guarantee absolute safety. I understand there are numerous risks associated with participating in the Camp’s activities, including, but not limited to, risks associated with the use of electronic devices, sewing and knitting equipment and supplies, and consuming Camp-provided food. Equipment used in activities may break, fail, or malfunction and cause injury. Some of the equipment used in activities may cause injuries even when used as intended. These are some, but not all, of the risks inherent in the Camp activities; a complete listing of inherent risks is not possible and some risks cannot be anticipated.
By accepting this waiver and signing up for this event, I authorize my child(ren) (“Release”) to participate in all activities operated by the Camp. On my own behalf and on behalf of my child(ren), I ACKNOWLEDGE THE RISKS associated with participation in the Camp’s activities and expressly and voluntarily assume the risks of participation in the activities operated by the Camp and HEREBY WAIVE AND RELEASE ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, COSTS, LOSSES, EXPENSES AND LIABILITIES (“CLAIMS”) (WHETHER ON BEHALF OF MY CHILD/CHILDREN OR FOR MY OWN BENEFIT) AGAINST THE CAMP (INCLUDING ITS STAFF, EMPLOYEES, AND AGENTS) THAT MAY ARISE FROM INJURIES, HARM OR LOSS RESULTING FROM PARTICIPATION IN THE ACTIVITIES OPERATED BY THE CAMP, INCLUDING (WITHOUT LIMITATION) ANY CLAIMS ALLEGING NEGLIGENCE BY THE CAMP (INCLUDING ITS STAFF, EMPLOYEES, AND AGENTS), to the fullest extent allowed under the laws of California, Colorado, District of Columbia, Georgia, Illinois, Massachusetts, New Jersey, New York, Oregon, Virginia, and Washington (as applicable based on the location of the camp, program, or event where your child/children attend or participate). If any aspect of this waiver is deemed to be invalid, I acknowledge that the remainder of the agreement will continue to have full force and effect. If my agreement on behalf of my child(ren) to release their Claims against the Camp is deemed invalid for any reason, I agree to indemnify, defend and hold the Camp harmless in connection with any Claims arising out of my child(ren)'s participation in the programs or events and activities operated by the Camp, including payment of reasonable defense costs incurred by the Camp.
I hereby authorize the staff of the Camp to act according to their best judgment in any situation requiring medical attention for the child(ren) attending the event. I understand that it is my responsibility to provide medical insurance coverage for the child/children while they are participating in the programs or events operated or conducted by the Camp and to provide accurate and complete medical information. I attest that all immunizations for the child/children attending any in-person events that are required by their school or local school district are up-to-date, OR I am refusing this requirement for medical reasons and am prepared to present medical documentation of those reasons. I acknowledge that the costs of any medical treatment provided to the child(ren) attending this event that are not covered by medical insurance will be my sole responsibility, consistent with the waiver of Claims above.
TERMS GOVERNING VIRTUAL PRESEASON EVENTS:
I understand and acknowledge that participation in online events or programs operated or conducted by Steve & Kate's Camp LLC (the "Camp") involves an inherent and unavoidable risk of injuries, harm, and loss. I further understand that, although the Camp takes precautions to provide proper organization, supervision and online safety measures, it is impossible for the Camp to guarantee absolute safety online.
I agree that my attendance and/or my child(ren)’s attendance at Steve & Kate’s Camp’s online events and activities is subject to the following terms and release of liability and waiver of rights to sue the Camp for risks related to attending the Camp’s online events and activities.
All use of Steve & Kate’s online events/activities is also subject to our Camp Community and Online Safety Guidelines and our Privacy Policy and COPPA Notice. The terms of each of these policies are hereby incorporated by reference into this Release.
Waiver of Liability/Assumption of Risk
The Camp has worked hard to ensure the quality and safety of our online events and programming. But there are some risks inherent in the online format which the Camp cannot control. By agreeing to this Release, You (the parent or guardian of the child(ren) you are registering) on your own behalf and on behalf of your child(ren), release the Camp from any and all liability for these risks. These risks include, but are not limited to:
Child(ren) physical safety and welfare: Our online activities are not childcare, and you remain responsible for ensuring the safety and well-being of your child(ren) while they participate in our online program. You agree to have someone over the age of 18 present to provide childcare/supervision for Your child(ren) at all times while they participate in our online events and activities.
Conduct of other children or families: While our staff is instructed in how to facilitate respectful conduct by children, and while the Camp reserves the right to terminate any family’s access to the Camp’s online events if serious misconduct occurs, the Camp cannot control the conduct of children or others present in the childrens’ on-screen background in “real-time.”
Online safety risks: Unfortunately, use of Zoom and other platforms come with the attendant risk of imposters entering the virtual premises under false pretenses. We will provide protected access to our registered families by unique event links, only available to those who RSVP to an event, but we want to make sure families do what they can to mitigate any safety risks. Explain online safety to your children, and caution them against revealing any of their contact, school or location information, or their login information or link, during the online programs. And make sure Your children know the potential dangers of unsupervised web surfing. While the Camp works hard to provide a safe experience and appropriate content for child(ren), You, and not the Camp, assume the risks attendant to the online format.
You authorize your child(ren) to participate in the Camp’s online activities/events and, on Your own behalf and on behalf of your child(ren), You acknowledge the risks inherent in our online activities/events and voluntarily agree to assume them and to release, indemnify and hold the Camp and its officers, owners, employees, directors and agents (collectively, “Releasees”) harmless from any from any and all losses, damages, expenses, including reasonable attorneys’ fees, rights, claims, actions of any kind, including negligence, and injury or death arising out of or relating to Your/Your children’s use of Steve & Kate’s online events/activities, Your violation of the aforementioned terms of use, or Your violation of any rights of another. If You are a California resident, You waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” If You are a resident of another jurisdiction, You waive any comparable statute or doctrine.
Registration: You will be required to register with the Camp in order for Your child(ren) to participate. By registering, You agree to provide and maintain true, accurate, current and complete information about Yourself and Your child(ren) as requested in the Camp’s registration forms. Registration data and certain other information about you are governed by our Privacy Policy and COPPA Notice. You cannot register unless you are of legal age to form a binding contract (in many jurisdictions, this age is 18). If you are not yet of legal age to form a binding contract, then you must get your parent or legal guardian to read this Release and agree to it for you before you participate in the Camp’s online activities/events. Parents and legal guardians, by registering your child(ren), You provide your consent to Your child(ren)’s participation in the Camp’s online activities/events and agree to be bound by the terms mentioned in this Release.
TERMS GOVERNING ALL PRESEASON EVENTS (VIRTUAL AND IN-PERSON):
The Camp reserves the right to expel or deny participation to any child(ren) if, in the Camp’s sole and absolute discretion, (i) the actions of a child(ren) or their parent/guardian disrupt, impede or interfere with the Camp’s ability to maintain a positive and constructive relationship with all participants and their parents/guardians, (ii) such actions threaten the safety of the child(ren), other children, or Camp staff, (iii) such actions otherwise interfere with the Camp’s accomplishment of its mission, or (iv) if expulsion would be in the best interest of the child(ren) or the Camp. The Camp will make every attempt to communicate with the child(ren) and the child(ren)’s parent/guardian regarding any actions that would put a child(ren) at risk of expulsion.
As to the child(ren)n attending any events, I agree that the Camp (including its staff, employees and agents) can take and use photos, video and audio recordings of the child/children attending for the limited purposes of marketing the Camp which may be publicly available on the internet, without compensational obligation, and I hereby release the Camp (including its staff, employees and agents) from any claims or liability resulting from their use of photos, videos and audio recordings. (Please note: if you want to better understand why we seek your consent for this or have any concerns regarding the use of photos/videos featuring your child(ren), please contact letschat@steveandkate.com). I agree to receive periodic email, phone or written communication from the Camp regarding products, services or information that may be of interest to me.
Further, I acknowledge and agree that the child(ren) attending events and myself and any co-parent or co-guardian, are not allowed to take, and shall not take, any photographs, video, or other recordings of other children, staff or other parents/guardians participating in the events or programs conducted by the Camp without their express consent, and are not allowed to transmit, upload, or post such content online or electronically including on social media sites, or use or publish such content in any non-personal media such as a book, video, film, television program or publicly viewable website. Upon the Camp’s request, I agree to delete and/or remove such content from any device, site, platform, or other media, if, in the Camp’s sole and absolute discretion, such content and/or the manner in which it is presented violates the terms of this agreement, is objectionable, inappropriate, or violates the privacy rights or right of publicity of others.
